1. About Us

Weigh & Buy is an online retail service operated by Miltonica Garb Private Limited, a company registered in the United Kingdom. By accessing or purchasing from our website, you agree to be bound by these Terms & Conditions in their entirety.

If you do not agree to these Terms, you must not use our website or purchase our products.

2. Our Business Model — Weight-Based Garment Sales

We sell garments priced by weight (kg) rather than per individual item. Key terms of our model are set out below:

  • Standard price: £30 per kg (inclusive of VAT where applicable) unless otherwise stated on our website
  • Minimum order: 1 kg
  • Quoted product weights are approximate and indicative only — variations may occur due to bulk sourcing
  • All garments are brand new and quality-checked before dispatch
  • Items may not include original retail packaging
  • Minor variations in style, colour, or item count within a weight bundle may occur
⚠️ UK Law Note — Weight-Based Sales Under the Consumer Rights Act 2015, all goods must be as described. Approximate weight descriptions must be reasonable and accurate. If a delivered order materially deviates from the described weight, you may have a right to a remedy under Section 19 of the CRA 2015.

3. Orders & Acceptance

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and the Consumer Rights Act 2015, the following applies to all orders:

  • An order placed on our website constitutes an offer by you to purchase goods
  • A contract is only formed once we send you a written order confirmation by email — not at the point of placing your order
  • We reserve the right to reject or cancel any order prior to dispatch, in which case a full refund will be issued within 14 calendar days
  • You will receive an email confirmation once payment is successfully processed
  • Pre-contract information provided on our website (including product descriptions and pricing) forms part of the contract under Section 11 of the Consumer Rights Act 2015

4. Pricing & Payment

  • All prices are shown in GBP (£)
  • VAT is included in the displayed price at checkout where applicable
  • Full payment must be received before goods are dispatched
  • We accept payment via our listed secure third-party payment processors
  • Under the Consumer Contracts Regulations 2013, we are prohibited from charging you for services you did not actively select — no default pre-ticked payment add-ons will be applied
  • Helpline calls by existing customers are charged at no more than basic rate, in compliance with Regulation 41 of the Consumer Contracts Regulations 2013

5. Delivery

All deliveries are subject to the following terms, which comply with the Consumer Rights Act 2015:

  • Orders are typically processed within 24 hours of payment confirmation
  • Unless a specific delivery date is agreed in writing, delivery will occur within 30 calendar days of order confirmation, in accordance with Section 28 of the Consumer Rights Act 2015
  • Delivery timelines shown on our website are estimates; delays may occur due to courier or logistics factors outside our control
  • Risk of loss or damage to goods remains with us until goods are delivered to you or to a person you have nominated to receive them, in line with Section 29 of the Consumer Rights Act 2015
  • If delivery is delayed beyond the agreed or statutory period, you have the right to cancel your order and receive a full refund
  • We are not liable for courier delays caused by third parties beyond our reasonable control; however, our liability to you under the Consumer Rights Act 2015 remains unaffected

6. Returns, Cancellations & Refunds

6.1  Your Statutory Right to Cancel (14-Day Cooling-Off Period)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 calendar days of receiving your goods, without giving any reason.

  • The 14-day cancellation period starts the day after you receive your goods
  • To cancel, notify us in writing by email at support@miltonicagarb.com before the period expires
  • Following cancellation notice, you must return the goods within 14 further days
  • We will issue a full refund — including standard outbound delivery costs — within 14 days of receiving the returned goods or proof of return, whichever is earlier
  • We may deduct an amount from your refund if goods show signs of handling beyond what is necessary to inspect them
  • Return delivery costs are your responsibility unless goods are faulty or not as described

6.2  Hygiene Exception — Security Tag Condition

The cancellation right in Regulation 28(3)(a) of the Consumer Contracts Regulations 2013 ceases to apply to sealed goods unsuitable for return due to health protection or hygiene reasons, once those goods are unsealed after delivery.

Accordingly, the following applies to our garments:

  • All garments are supplied with a tamper-evident security tag. The tag constitutes the seal for hygiene protection purposes
  • If the security tag is removed or tampered with after delivery, you lose the right to cancel under the Consumer Contracts Regulations
  • This exception applies only because garments are hygiene-sensitive goods. Garments that have been worn, washed, or have signs of use will not be accepted for return

If the tag remains intact and the garment is unused, your 14-day cancellation right is unaffected

⚠️ IMPORTANT — Statutory Rights Are NOT Excluded Nothing in our Returns Policy removes or restricts your rights under the Consumer Rights Act 2015 in the event of faulty, misdescribed, or unsatisfactory goods. If goods are defective or not as described, your right to a remedy (repair, replacement, or refund) applies regardless of the security tag status.

6.3  Faulty or Misdescribed Goods

Under the Consumer Rights Act 2015, you have the following statutory rights if goods are faulty, not of satisfactory quality, or not as described:

  • Short-term right to reject: within 30 days of receiving the goods, you may return them for a full refund
  • After 30 days but within 6 months: you are entitled to a repair or replacement first. If that is not possible, a refund may be given
  • After 6 months: you may still have remedies, but the burden of proof shifts to you to demonstrate the fault existed at the time of delivery

These rights apply regardless of the security tag status.

6.4  Weight-Based Bundle Returns

  • Due to the nature of our weight-based model, we are unable to accept partial returns of a bundle
  • Returns must include the complete order weight as originally delivered
  • If items are missing from a return, we reserve the right to reject the return or make a proportionate deduction from any refund issued
  • This condition does not apply where goods are faulty or misdescribed, in which case your full statutory rights apply

7. Security Tag Policy

All garments are fitted with a tamper-evident security tag prior to dispatch.

⚠️  Tag Warning — Displayed on Product Page, Checkout, Packaging & Tag Itself “Do not remove the security tag unless you are keeping the item. Removing the tag voids your right to cancel under the Consumer Contracts Regulations 2013 for hygiene-protected goods. Statutory rights for faulty or misdescribed goods are not affected.”
  • Removing the tag constitutes acceptance that the item has been worn or used for hygiene purposes
  • Items with removed, damaged, or tampered tags will not be accepted for return under our cancellation policy
  • This policy is applied consistently to maintain hygiene, quality standards, and fairness to all customers
  • This policy is lawful under Regulation 28(3)(a) of the Consumer Contracts Regulations 2013 and does not remove your rights for defective goods

8. Product Condition

  • All products supplied by Weigh & Buy are brand new and subject to quality checks before dispatch
  • Goods must be of satisfactory quality, fit for purpose, and as described, in accordance with Sections 9–11 of the Consumer Rights Act 2015
  • Items may not include original retail manufacturer packaging

Due to the nature of bulk sourcing, minor variations in product style, colour, or type within a weight bundle may occur — any such variations will be within the reasonable scope of the product description

9. Limitation of Liability

To the fullest extent permitted by law, Weigh & Buy’s liability is limited as follows:

  • We are not liable for indirect or consequential losses, loss of profit, business loss, or loss of opportunity
  • We are not liable for delays caused by third-party logistics providers, provided we have met our obligations under Section 28 of the Consumer Rights Act 2015
  • Our total aggregate liability for any claim shall not exceed the amount you paid for the relevant order
⚠️  UK Law — What We Cannot Exclude Under the Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977, we cannot limit or exclude liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of your statutory consumer rights, including rights to satisfactory quality and fitness for purpose; or (d) any other liability that cannot be lawfully excluded. Any term purporting to do so is void.

10. Fraud & Chargeback Protection

We take the security and integrity of our transactions seriously. The following measures apply, consistent with our lawful rights:

  • We actively monitor orders for signs of fraud or abuse
  • We reserve the right to refuse suspicious orders or request additional verification before dispatch
  • In the event of a disputed transaction or chargeback, we will provide evidence to our payment processor, including proof of delivery, tracking records, product condition records, and security tag status
  • Any fraudulent chargeback claim may be reported to relevant authorities and may be pursued legally

Nothing in this clause affects your right to raise a legitimate dispute with your bank or payment provider.

11. Intellectual Property

All website content, branding, trademarks, imagery, and materials are the property of Weigh & Buy / Miltonica Garb Private Limited and are protected by applicable intellectual property laws. Unauthorised use, reproduction, or distribution is strictly prohibited.

12. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. Updated terms will be published on our website with the revised effective date. Your continued use of our website after changes are posted constitutes acceptance of the revised Terms. For orders already placed, the Terms in force at the time of your order apply.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating legal proceedings, we encourage you to contact us at support@miltonicagarb.com to attempt to resolve any dispute informally. We aim to respond to complaints within 5 working days. If you are not satisfied with our resolution, you may be entitled to refer your dispute to an Alternative Dispute Resolution (ADR) provider or the courts.
